CAR REPAIR TERMS AND CONDITIONS - KAM3D AUTOMOTIVE LTD

BACKGROUND:
These Terms and Conditions are the standard terms which apply:
A. to the provision to the Customer of any Services by KAM3D Automotive LTD; and
B. where the Customer is a Consumer.

1. Definitions and Interpretation
1.1 In these Terms and Conditions, the following expressions have the following meanings:

• Consumer: An individual who receives any of the Services for personal use and not for any business, trade, craft, or profession.
• Customer/You/Your: A Consumer customer of KAM3D Automotive LTD who requires its Services.
• Estimate: An estimate of the approximate Price of the Work.
• KAM3D Automotive LTD/Us/We/Our: KAM3D Automotive LTD of Park Farm, West End Lane, Warfield, RG42 5RH, and reference to KAM3D Automotive LTD shall include reference to its staff.
• Vehicle: Your vehicle which may be a car, van, motorhome, motorcycle, caravan, or trailer.
• Price: The fee payable for the Work including parts, labour, VAT, and any additional charges.
• Services: Any type of repair or maintenance of Vehicles.
• Work: The particular services that we agree to provide to you.

2. Booking
2.1 You can request a booking for our Services by contacting us directly or through our website.
2.2 Once we have all the details, we will provide you with an Estimate for the Work.
2.3 Late arrival as per the agreed booking time, without prior notice, may incur additional charges.

3. Price and Payment
3.1 The Price will be as quoted in our Estimate.
3.2 Payment is due upon completion of the Work unless a payment term has been agreed upon prior to accepting the Estimate.
3.3 In the event of late payment, an additional fee of 8% of the total invoice amount will be applied.
3.4 Unexpected additional costs may arise during the Work due to issues such as snapped bolts, rust, corrosion, or other unforeseen factors. Any such additional costs will be communicated to you promptly, and your approval will be sought before proceeding.

4. Collection and Delivery
4.1 We may offer to collect your Vehicle and deliver it back to you after the Work is complete.
4.2 Any collection or delivery will be at our discretion and will be subject to an additional charge, depending on the location and time.

5. Liability
5.1 We will not be liable for any damage caused by pre-existing issues or conditions of the Vehicle that were not disclosed to us prior to the Work.
5.2 Our total liability for any loss or damage caused as a result of our negligence or breach of these Terms and Conditions or of statutory duty shall be limited to the Price.

6. Customer's Obligations
6.1 You must ensure that the Vehicle is in a condition suitable for the Work to be carried out and inform us of any issues or conditions that might affect the Work.
6.2 You must remove all personal items from the Vehicle before the Work begins. We will not be responsible for any loss or damage to personal items left in the Vehicle.

7. Cancellations
7.1 You have the right to cancel a booking. However, if the Work has been agreed upon and parts have already been ordered, you will be charged for the cost of the parts but not the labour.

8. Complaints
8.1 We always aim to provide the best service possible. However, if you have any complaints, please contact us directly, and we will do our best to resolve the issue.

9. Data Protection
9.1 All personal information that we may collect will be collected, used, and held in accordance with the provisions of the Data Protection Act 2018 and your rights under that Act.

10. Force Majeure
10.1 We will not be liable for any failure or delay in performing our obligations where that failure or delay results from any cause that is beyond our reasonable control.

11. Severance
11.1 If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected.

12. Changes to Terms and Conditions
12.1 We may alter these Terms and Conditions at any time. Any such changes will become binding on you upon your first use of our Services after the changes have been implemented.

13. No Waiver
13.1 No failure or delay by us in exercising any of our rights under these Terms and Conditions means that we have waived that right, and no waiver by us of a breach of any provision of these Terms and Conditions means that we will waive any subsequent breach of the same or any other provision.

14. Third Party Rights
14.1 No part of these Terms and Conditions is intended to confer rights on any third parties and accordingly the Contracts (Rights of Third Parties) Act 1999 shall not apply.

15. Communications
15.1 All notices under these Terms and Conditions will be in writing and signed by, or on behalf of, the party giving notice (or a duly authorised officer of that party).

16. Law and Jurisdiction
16.1 These Terms and Conditions and the relationship between you and us shall be governed by and construed in accordance with English Law.
16.2 Any dispute between you and us relating to these Terms and Conditions shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.
