KAM3D AUTOMOTIVE LTD
These Terms and Conditions apply to the provision of vehicle repair and maintenance services by KAM3D Automotive LTD to consumers.
Consumer
An individual acting for purposes wholly or mainly outside their business, trade, craft, or profession.
Customer / You / Your
A consumer who engages KAM3D Automotive LTD to provide Services.
Estimate
A non-binding estimate of the likely Price of the Work, based on information available at the time.
KAM3D Automotive LTD / We / Us / Our
KAM3D Automotive LTD of Park Farm, West End Lane, Warfield, RG42 5RH, including its employees and agents.
Vehicle
Any vehicle including, but not limited to, cars, vans, motorhomes, motorcycles, caravans, or trailers.
Price
The total amount payable for the Work, including labour, parts, VAT, and any additional approved charges.
Services
Vehicle inspection, diagnostics, repair, servicing, and maintenance.
Work
The Services agreed to be carried out on the Vehicle.
2.1 Bookings may be requested by phone, email, in person, or via our website.
2.2 An Estimate will be provided once sufficient details are known.
2.3 Late arrival or failure to attend a booking without prior notice may result in additional charges or cancellation of the booking.
3.1 All Estimates are indicative only and do not constitute a fixed price unless expressly agreed in writing.
3.2 Payment is due immediately upon completion of the Work, unless otherwise agreed in writing beforehand.
3.3 We reserve the right to charge statutory interest on overdue invoices at 8% above the Bank of England base rate, calculated daily from the due date until payment is received in full.
3.4 Additional costs may arise due to unforeseen issues including, but not limited to, seized, corroded, rusted, or snapped components. Any such costs will be communicated and approved before further Work is carried out.
4.1 Collection and delivery services may be offered at our discretion and may incur additional charges.
4.2 We may move, start, or road test the Vehicle where reasonably necessary for diagnostics, repair, verification, or safety purposes.
5.1 We reserve the right to retain possession of the Vehicle until all outstanding sums owed to us have been paid in full in cleared funds.
6.1 We are not responsible for damage or failure arising from pre-existing faults, age-related wear, corrosion, rust, previous repairs, or manufacturer defects.
6.2 Our total liability for loss or damage caused by our negligence shall be limited to the Price paid for the Work, except where liability cannot be limited or excluded by law.
6.3 Nothing in these Terms excludes or limits your statutory rights under the Consumer Rights Act 2015.
7.1 You must ensure the Vehicle is safe, accessible, and suitable for the Work to be carried out.
7.2 You must remove all personal belongings from the Vehicle before Work begins. We accept no responsibility for loss or damage to items left in the Vehicle.
8.1 You may cancel a booking at any time.
8.2 If parts have been ordered specifically for your Vehicle, you will be charged for the cost of those parts.
8.3 Same-day cancellations or failure to attend a confirmed booking without notice may incur a reasonable administration or labour charge.
9.1 We aim to provide a high standard of service at all times. Any complaints should be raised with us as soon as reasonably possible.
9.2 All complaints relating to the Work must be notified to us in writing within 14 days of the invoice date.
9.3 Where no complaint is raised within this 14-day period, the Work and Price shall be deemed accepted, and no goodwill refunds, discounts, or price reductions will be offered.
9.4 Nothing in this clause affects or limits your statutory rights under the Consumer Rights Act 2015.
10.1 Personal data will be collected, used, and stored in accordance with the UK GDPR and the Data Protection Act 2018.
11.1 We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control.
12.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13.1 We reserve the right to amend these Terms and Conditions from time to time. The version in force at the time of booking shall apply.
14.1 Failure or delay by us to enforce any right shall not constitute a waiver of that right.
15.1 The Contracts (Rights of Third Parties) Act 1999 shall not apply to these Terms.
16.1 These Terms and Conditions shall be governed by and construed in accordance with English law.
16.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
